Mobile Power Packs Recalled By Tumi Due to Fire Hazard

According to Release # 10-169, the U.S. Consumer Product Safety Commission (CPSC) announced the recall by Tumi, of South Plainfield, N.J. of about 5,000 Mobile Power Packs. The recalled Mobile Power Pack is a mobile device that receives an AC charge in a compact battery pack that will then give five DC charges to small electronic devices including mobile phones, MP-3 players, Blackberries, and PDAs. The power pack is black and silver and is rectangular in shape. The front of it has a small circular control panel. The front also displays the word “Tumi” engraved on a silver button located towards the bottom of the device. Style number 14362 is printed on the power pack packaging. They were sold at Tumi retail stores, department and specialty stores nationwide and www.Tumi.com from August 2007 through March 2008 for $135. According to the Release, the lithium-ion cells used in the Mobile Power Pack can ignite or explode while charging, posing a fire hazard. Gerber Legendary Blades Recalls Machetes Due to Laceration Hazard

According to Release # 10-157, the U.S. Consumer Product Safety Commission (CPSC) announced the recall by Gerber Legendary Blades, of Portland, Ore., a division of Fiskars Brands Inc., of Madison, Wisconsin, of about 149,000 Gator Machetes and 6,000 Gator Machetes Jr. The recall involves the Gerber Gator Machete and Gator Machete Jr. with the original handle. The Gator Machete is approximately 25 1/2″ long and the Machete Jr. is approximately 18 3/4″ long. The blade is marked with the “Gerber” trademark. The Gator Machete and Machete Jr. with a modified handle (an extended hand guard) are not included in this recall. Consumers should visually inspect their machete to determine if it is included in this recall. They were sold at retail stores nationwide, including The Sportsman’s Guide, Dick’s Sporting Goods and Bass Pro Shops/American Rod & Gun, and through on-line stores from March 2007 through February 2010 for between $16 and $25. According to the Release, the saw side of the machete can stick in wood during use, and if the user’s hand slips off the handle and slides forward across the machete blade, it poses a laceration hazard. Outdoor Lighting Fixtures Recalled by American Electric Lighting Due to Shock Hazard

According to Release # 10-154, the U.S. Consumer Product Safety Commission (CPSC) announced the recall by American Electric Lighting, a division of Acuity Brands Lighting Inc., of Conyers, Ga., of about 900 outdoor lighting fixtures. The recall involves model AVL outdoor lighting fixtures sold under the American Electric Lighting brand name. The light fixtures are intended for use in parking lots, roadways, commercial environments and office communities. “AVL” is printed on the reflector of each light fixture. They were sold by electrical distributors and electrical sales representatives nationwide from September 2008 through September 2009 for between $250 and $800. According to the Release, improper wiring in the light fixtures poses a shock hazard to consumers. For more information, visit U.S. CPSC.

Rebenack Obtains Dismissal of East Brunswick DWI Charge

RAM Law’s client was a patron at the Bone Fish Grill in East Brunswick on a first date. After a number of hours, the restaurant closed and the client and his date returned to the client’s car. The client started the car and continued to talk to his date for the next 30 minutes without moving the car. At approximately 1:45 am, an East Brunswick police officer came upon the scene. The officer had the client perform a field sobriety test and then arrested him for failing. The client was then given a breathalyzer test which registered a .09 BAC. The client was issued a summons for DWI and reckless driving.

The prosecutor must prove operation to sustain a DWI conviction. However, proof of intent to operate, even without actual operation, is enough for a conviction. Rebenack explained that the client was on a first date and engaged in activities that might be expected under the circumstances. As a result, Rebenack argued, the client had no intention of moving the vehicle until the first date ended. As a result, the prosecutor acknowledged that intent to operate the vehicle at the time of the arrest could not be proven beyond a reasonable doubt and thus, all charges were dismissed. The client avoided a 3 month license suspension, as well as hefty fines and surcharges.

Craig Aronow Nominated to MCBA Secretary Position

The Middlesex County Bar Association’s Nominating Committee has selected RAM Law partner, Craig Aronow, to serve as the MCBA’s next secretary. The secretary generally ascends to the MCBA presidency after holding the other MCBA officer positions, which include, treasurer, second vice president, first vice president, and president elect. The selection continues RAM Law’s participation in the largest professional legal organizations in the state and the tapping of the firm’s partners as leaders. Craig has been active in the MCBA since his admission to the bar in 1998. For the past several years, he has been a trustee and chaired several very successful committees, including the Civil Trial Practice Committee. Craig looks forward to working with the other members of the MCBA Executive Committee, its trustees and continuing the MCBA’s great legacy of giving back to Middlesex County’s legal community and the community at-large.

Commercial Ice Cube Machines Recalled by Scotsman Due to Fire Hazard

According to Release # 10-147, the U.S. Consumer Product Safety Commission (CPSC) announced the recall by Scotsman Group LLC, of Vernon Hills, Ill., of about 43,000 Scotsman® Commercial Modular Cube Ice Machines (Modular Cubers). The recalled machines are designed to be installed on top of ice storage bins or ice dispensers, and typically are used in commercial establishments. Model numbers begin with C0322, C0330, C0522, C0530, C0630, C0830, C1030, C1448, C1848, C2148, EH130, EH222, EH330, or EH430, and serial numbers of the recalled machines within these model designations begin with 05, 06, 07, 08 or 09. Model and serial numbers are on the back of all machines and, depending on the model, behind the machine’s front panel either in the lower right corner of the machine or on the left side of the sheet metal wall that separates the larger (equipment) compartment from the smaller (ice-making) compartment. Scotsman® commercial flake and nugget ice machines, commercial undercounter cube ice machines, and residential ice machines are not involved in this recall. The recalled units were sold exclusively at commercial food service equipment distributors and dealers nationwide from September 2006 through December 2009 for between $4,000 and $14,000. According to the Release, the solenoid, an electrical component in the product, can fail and result in an electrical arc that can pose a fire hazard. For more information, visit U.S. CPSC.

Climate Control Footrests Recalled by Fellowes Due to Fire Hazard

According to Alert # 10-723, the U.S. Consumer Product Safety Commission (CPSC) announced the recall by Fellowes, Inc., of Itasca, Ill., of about 1,000 Fellowes Climate Control Footrests. The recalled footrests are black and made of plastic. The Fellowes brand item #80309 can be found on the serial label at the bottom side of the footrest, which can be identified by Revision or letter “A” on the label, which appears after the date code. The footrests were sold by Business to Business resellers only, including Office Depot Business Services Division, SP Richards, Staples Advantage, United Stationers, Tri-Mega, and WW Grainger, from October 2009 through January 2010 for about $73.. These products were not sold in retail locations. According to the Alert, the footrest’s fan can become blocked and overheat when used in the upright position, posing a fire hazard. Bristol Model and Martha Stewart Collection® Enameled Steel Tea Kettles Recalled Due to Burn Hazard

According to Release # 10-146, the U.S. Consumer Product Safety Commission (CPSC) announced the recall by Copco, a division of Wilton Industries Inc., of Woodridge, Ill., of about 132,000 Copco and Wild Leaf Tea Co. Bristol model and Martha Stewart Collection® Enameled Steel Tea Kettles with enamel finishes in white, crème, blue, cobalt, sand, red and green. The kettles were sold by mail order, online and by retailers nationwide, including Macy’s and Linens ‘n Things from October 2005 through January 2010 for about $35. According to the Release, the handle on the tea kettle can come loose, posing a burn hazard to the consumer. The firm has received eight reports of the handle becoming loose or deformed. Arctic Cat Recalls Snowmobiles Due to Fire Hazard

According to Alert # 10-721, the U.S. Consumer Product Safety Commission (CPSC) announced the recall by Arctic Cat Inc. of Thief River Falls, Minn. of about 1300 Arctic Cat Snowmobiles. The recall involves all Model Year 2010 Arctic Cat 500 Sno Pro models. The model name and number are displayed on the side of the seat and on the engine cowling. The snowmobiles were sold at Arctic Cat dealerships nationwide from October 2009 to February 2010 for between $7,800 and $8,200. According to the Alert, fuel can leak from the fuel pump at the fuel tank mounting screws, posing a fire hazard to consumers. For more information, visit U.S. CPSC.
